Purchasing from www.flaakcosmetic.com implies full and unconditional acceptance of these Terms and Conditions of Sale (“T&Cs”).
These T&Cs inform customers about ordering, payment, delivery, returns, refunds, warranties, liability, and customer support for products sold by NEW COLOR under the brand FLAAK Cosmetic.
1. General
These T&Cs apply without restriction or reservation to all products offered on www.flaakcosmetic.com, to consumers who are at least 18 years old and legally capable of entering into a contract.
Placing an order constitutes acceptance of these T&Cs. These T&Cs prevail over any other document unless expressly agreed otherwise in writing.
The T&Cs may be updated at any time without prior notice. The version applicable is the one in force at the time of ordering.
These T&Cs are governed by French law. In the event of a dispute and failing an amicable resolution, competent French courts shall have jurisdiction, without prejudice to any mandatory consumer rights.

3. Products and Intended Use
FLAAK Cosmetic products are cosmetic, non-corrective (plano) contact lenses intended solely for aesthetic purposes (including keratopigmentation simulation).
They do not correct vision, are not classified as medical devices, and do not replace a medical examination or procedure.
Essential characteristics (shade, material, wear schedule, certifications, expiration date) are shown on each product page. Images are illustrative and non-contractual; colour perception may vary.
Customers must follow the hygiene and safety instructions provided for insertion, removal, cleaning, storage, and wearing time. Improper use may cause discomfort or adverse effects.

The sale is concluded once payment is successfully processed. Customers are responsible for the accuracy of submitted information. NEW COLOR is not liable for delays or failed delivery caused by incorrect or incomplete information.
Products are offered subject to availability. In case of stock unavailability, customers will be informed and may request a refund or choose to wait for restocking.
5. Prices
Prices are displayed in euros (€), including VAT, and exclude delivery fees unless stated otherwise. The total payable amount (products + shipping + applicable taxes or duties) is shown at checkout before confirmation.
Prices may change at any time. The price applicable is the one shown at the time of order confirmation.
In case of VAT rate changes, prices will be adjusted accordingly.

6. Payment
Payment is due at the time of ordering via secure checkout.

7. Shipping and Delivery
Orders are prepared within 24–48 business hours. Delivery times vary by destination and carrier. Orders are shipped Monday to Friday (excluding public holidays).
A shipment confirmation with a tracking number is sent by email.

Delivery times are estimates and may be extended due to carrier delays, customs processing, remote areas, weather conditions, or peak periods. Customs duties and local taxes may apply for shipments outside the European Union and are the customer’s responsibility.
Customs & Duties (non-EU)
Any import taxes, duties, or customs clearance fees are the Customer’s responsibility and are not included in the order total.
Force Majeure
The Company is not liable for delays due to events beyond its reasonable control (Article 1218, French Civil Code).
Address Issues
If a parcel is returned due to incorrect, incomplete, or unreadable address details, reshipment will only occur once the Customer pays the additional shipping cost. Initial shipping costs are non-refundable once the parcel has been handed to the carrier.
8. Right of Withdrawal and Returns (EU Consumers)
In accordance with Articles L221-18 et seq. of the French Consumer Code, EU consumers have 14 days from receipt to withdraw from their purchase, without providing a reason.
However, per Article L221-28, the right of withdrawal does not apply to sealed products unsealed after delivery for hygiene or health protection reasons.
Therefore, returns are accepted only if:

The blister is fully sealed and unopened

The outer box is intact and suitable for resale

The product shows no signs of use or handling
Return shipping costs are borne by the Customer. The parcel must be securely packaged and sent with tracking.

All returned items are subject to inspection. If accepted, a refund will be processed within 14 days.
If rejected (e.g. opened, used, damaged), no refund will be issued. The item may be returned to the Customer at their expense upon request. Otherwise, it may be destroyed for hygiene reasons.
Defects or Order Errors

You may be asked to provide photos of the product, box, and batch number.
If confirmed, we will offer an exchange (subject to availability) or a refund, at no cost.
9. Product Conformity and Quality Checks
Products comply with applicable regulations for non-corrective cosmetic lenses. Certifications (e.g. CE, ISO, FDA) may apply by region.
To assess a defect claim, the Customer must provide:

Photo of the box showing lot/batch number and product name
Failure to provide these may result in rejection of the claim.
10. Warranties
Products benefit from the statutory legal warranties under French and EU law:

Warranty of conformity (French Consumer Code, L217-4 et seq.)

Warranty against hidden defects (French Civil Code, 1641 et seq.)
Where applicable, the Customer may request a refund, repair, or replacement, within the limits set by law.
These rights apply independently of any commercial guarantee.
11. Health and Safety Guidance

Only use lenses as instructed and never exceed recommended wear time

Discontinue use if you experience discomfort, redness, or pain

Maintain proper hygiene (clean hands, safe storage, correct handling)

FLAAK lenses do not replace medical advice or eye exams
The Company is not liable for damage resulting from misuse or failure to follow instructions.
12. Limitation of Liability
The Company is not liable for indirect or consequential damages.
Nothing in these T&Cs limits liability where such limitation is unlawful, including cases of fraud, personal injury, or breach of mandatory consumer protections.
13. Intellectual Property
All content on www.flaakcosmetic.com (brand name, logo, visuals, designs, texts) is the exclusive property of NEW COLOR.
Unauthorised use, copying, or distribution is strictly prohibited and may lead to legal action.
14. Personal Data (GDPR)
Customer data is collected and processed for purposes including order management, customer support, delivery, invoicing, and fraud prevention.
Data is processed in accordance with the General Data Protection Regulation (GDPR) and applicable laws.
Personal data is stored for the duration necessary for its purpose and may be shared with service providers (e.g. payment, logistics) under strict confidentiality.
Customers have the right to access, rectify, delete, restrict, object, or request portability of their personal data.

16. Miscellaneous
Force majeure: Applies in accordance with Article 1218 of the French Civil Code.
Severability: If any provision is found invalid, the rest shall remain enforceable.
No waiver: Failure to enforce any provision shall not be deemed a waiver.
Assignment: NEW COLOR may assign its rights and obligations in the event of business transfer.
17. Translations and Precedence
FLAAK Cosmetic is operated by NEW COLOR SAS, a French company. These Terms are originally written in English for international customers.
Translations may be made available. In case of conflict, the version applicable under local law will prevail for the consumer's jurisdiction.
